關于進一步深化環境影響評價改革的通知
發布日期:2024-09-25 15:28:12 瀏覽量:為貫(guan)徹黨(dang)(dang)的二十(shi)大(da)(da)和二十(shi)屆三(san)中全會精神,落(luo)實全國生態環境(jing)保(bao)護(hu)大(da)(da)會和黨(dang)(dang)中央、國務院(yuan)關于(yu)優化(hua)營商(shang)環境(jing)有關決策(ce)部署(shu),深化(hua)環境(jing)影響評價(jia)改革,強(qiang)化(hua)環境(jing)影響評價(jia)源頭預(yu)防作用(yong),生態環境(jing)部于(yu)2024年(nian)9月14日發布了《關于(yu)進一(yi)步深化(hua)環境(jing)影響評價(jia)改革的通知》(環環評[2024]65號),具體如下:
一、改(gai)革的(de)總(zong)體(ti)思路
統籌優化(hua)環(huan)(huan)(huan)(huan)評(ping)分(fen)級分(fen)類(lei)管(guan)理,實(shi)現環(huan)(huan)(huan)(huan)評(ping)分(fen)級管(guan)理與基層管(guan)理能力(li)更(geng)(geng)相適(shi)應,生態(tai)環(huan)(huan)(huan)(huan)境影響重大項目(mu)由(you)部省兩(liang)級生態(tai)環(huan)(huan)(huan)(huan)境部門負責;實(shi)現環(huan)(huan)(huan)(huan)評(ping)分(fen)類(lei)管(guan)理與排(pai)污許可制(zhi)度更(geng)(geng)為銜(xian)接,污染影響類(lei)建設(she)項目(mu)環(huan)(huan)(huan)(huan)評(ping)數量大幅壓減,充分(fen)發(fa)揮(hui)生態(tai)環(huan)(huan)(huan)(huan)境分(fen)區管(guan)控(kong)和(he)規(gui)劃環(huan)(huan)(huan)(huan)評(ping)對項目(mu)環(huan)(huan)(huan)(huan)境準入的指導作用,持(chi)續增強環(huan)(huan)(huan)(huan)評(ping)信息化(hua)支(zhi)撐,持(chi)續提高環(huan)(huan)(huan)(huan)評(ping)文件質量,顯著提升源頭預防(fang)體系整體效力(li)。
二(er)、優化建設(she)項(xiang)目環(huan)評分級審批
(一)加強(qiang)省(sheng)級對(dui)重大項(xiang)(xiang)(xiang)目(mu)(mu)(mu)環(huan)(huan)(huan)評(ping)的(de)(de)(de)審(shen)批(pi)管理。除(chu)生(sheng)態(tai)環(huan)(huan)(huan)境部負責審(shen)批(pi)環(huan)(huan)(huan)評(ping)的(de)(de)(de)建設項(xiang)(xiang)(xiang)目(mu)(mu)(mu)外,存(cun)在(zai)(zai)重大生(sheng)態(tai)環(huan)(huan)(huan)境不(bu)利影(ying)響的(de)(de)(de)項(xiang)(xiang)(xiang)目(mu)(mu)(mu)環(huan)(huan)(huan)評(ping)原則上應由(you)省(sheng)級生(sheng)態(tai)環(huan)(huan)(huan)境部門(men)審(shen)批(pi),包括:煉油、乙烯(xi)、鋼鐵、焦化(hua)、煤(mei)化(hua)工(gong)、燃煤(mei)發電(dian)、有(you)色金屬冶煉、水(shui)泥熟料、平(ping)板玻璃等(deng)工(gong)業重點領域項(xiang)(xiang)(xiang)目(mu)(mu)(mu),水(shui)庫、引水(shui)工(gong)程、常規水(shui)電(dian)站、抽水(shui)蓄能電(dian)站、礦產資(zi)源(yuan)開(kai)發、危險(xian)廢(fei)物處置、圍填海工(gong)程等(deng)存(cun)在(zai)(zai)重大生(sheng)態(tai)影(ying)響的(de)(de)(de)項(xiang)(xiang)(xiang)目(mu)(mu)(mu),采用(yong)新型生(sheng)產工(gong)藝技術、產排污情況及生(sheng)態(tai)環(huan)(huan)(huan)境影(ying)響存(cun)在(zai)(zai)較大不(bu)確定性的(de)(de)(de)項(xiang)(xiang)(xiang)目(mu)(mu)(mu)(目(mu)(mu)(mu)錄(lu)詳見(jian)附(fu)件1)。對(dui)該目(mu)(mu)(mu)錄(lu)外的(de)(de)(de)建設項(xiang)(xiang)(xiang)目(mu)(mu)(mu),各省(sheng)份可因地制宜(yi)對(dui)特(te)定行(xing)業提出嚴(yan)格(ge)要求,不(bu)得(de)隨意層(ceng)(ceng)層(ceng)(ceng)下放項(xiang)(xiang)(xiang)目(mu)(mu)(mu)環(huan)(huan)(huan)評(ping)審(shen)批(pi)權限。西藏、青(qing)海、甘肅(su)、寧夏(xia)、內蒙古等(deng)省(sheng)(區)生(sheng)態(tai)環(huan)(huan)(huan)境影(ying)響重大的(de)(de)(de)礦產資(zi)源(yuan)開(kai)發等(deng)項(xiang)(xiang)(xiang)目(mu)(mu)(mu)環(huan)(huan)(huan)評(ping)建議(yi)由(you)省(sheng)級生(sheng)態(tai)環(huan)(huan)(huan)境部門(men)審(shen)批(pi)。
( 二(er))做好省(sheng)(sheng)級(ji)以(yi)下項(xiang)(xiang)目(mu)(mu)(mu)(mu)環(huan)(huan)(huan)(huan)(huan)評(ping)審(shen)(shen)(shen)(shen)批(pi)(pi)權限評(ping)估(gu)調整。省(sheng)(sheng)級(ji)生態(tai)環(huan)(huan)(huan)(huan)(huan)境(jing)(jing)部門(men)應(ying)組織開展項(xiang)(xiang)目(mu)(mu)(mu)(mu)環(huan)(huan)(huan)(huan)(huan)評(ping)審(shen)(shen)(shen)(shen)批(pi)(pi)權限梳理(li)和承接效(xiao)果評(ping)估(gu),確保與基層能(neng)(neng)力相(xiang)匹配。除生態(tai)環(huan)(huan)(huan)(huan)(huan)境(jing)(jing)部和省(sheng)(sheng)級(ji)生態(tai)環(huan)(huan)(huan)(huan)(huan)境(jing)(jing)部門(men)負責審(shen)(shen)(shen)(shen)批(pi)(pi)環(huan)(huan)(huan)(huan)(huan)評(ping)的(de)建設(she)(she)項(xiang)(xiang)目(mu)(mu)(mu)(mu)外,其他編(bian)制環(huan)(huan)(huan)(huan)(huan)境(jing)(jing)影(ying)響報(bao)告書的(de)建設(she)(she)項(xiang)(xiang)目(mu)(mu)(mu)(mu),原(yuan)則上應(ying)由地級(ji)市(市轄區(qu))的(de)生態(tai)環(huan)(huan)(huan)(huan)(huan)境(jing)(jing)部門(men)負責審(shen)(shen)(shen)(shen)批(pi)(pi)項(xiang)(xiang)目(mu)(mu)(mu)(mu)環(huan)(huan)(huan)(huan)(huan)評(ping)。設(she)(she)區(qu)的(de)市級(ji)生態(tai)環(huan)(huan)(huan)(huan)(huan)境(jing)(jing)部門(men)原(yuan)則上僅可將(jiang)部分(fen)環(huan)(huan)(huan)(huan)(huan)境(jing)(jing)影(ying)響報(bao)告表審(shen)(shen)(shen)(shen)批(pi)(pi)的(de)具(ju)體工作授(shou)權給區(qu)縣生態(tai)環(huan)(huan)(huan)(huan)(huan)境(jing)(jing)部門(men),不得將(jiang)環(huan)(huan)(huan)(huan)(huan)境(jing)(jing)影(ying)響報(bao)告書審(shen)(shen)(shen)(shen)批(pi)(pi)的(de)具(ju)體工作授(shou)權給區(qu)縣生態(tai)環(huan)(huan)(huan)(huan)(huan)境(jing)(jing)部門(men)。省(sheng)(sheng)級(ji)生態(tai)環(huan)(huan)(huan)(huan)(huan)境(jing)(jing)部門(men)應(ying)切實做好涉及集中行(xing)政審(shen)(shen)(shen)(shen)批(pi)(pi)改革的(de)地區(qu)項(xiang)(xiang)目(mu)(mu)(mu)(mu)環(huan)(huan)(huan)(huan)(huan)評(ping)審(shen)(shen)(shen)(shen)批(pi)(pi)效(xiao)果評(ping)估(gu),發現(xian)行(xing)政審(shen)(shen)(shen)(shen)批(pi)(pi)局(ju)項(xiang)(xiang)目(mu)(mu)(mu)(mu)環(huan)(huan)(huan)(huan)(huan)評(ping)審(shen)(shen)(shen)(shen)批(pi)(pi)能(neng)(neng)力不足、質量難(nan)以(yi)把關的(de),應(ying)向省(sheng)(sheng)級(ji)人民政府提(ti)出完(wan)善建議。
三(san)、開(kai)展優(you)化建設項目環評分類管理試點
(一(yi))選(xuan)取(qu)部分(fen)地(di)級市(shi)(shi)開展(zhan)(zhan)優(you)化環(huan)(huan)(huan)評(ping)分(fen)類管理(li)試(shi)點(dian)(dian)。請北(bei)京市(shi)(shi)、河(he)北(bei)省(sheng)、吉林省(sheng)、福(fu)建(jian)省(sheng)、廣東省(sheng)、四(si)川省(sheng)、陜西(xi)省(sheng)等(deng)7省(sheng)(市(shi)(shi))生態(tai)環(huan)(huan)(huan)境(jing)(jing)廳(局(ju))統(tong)籌(chou)考(kao)慮經濟發(fa)展(zhan)(zhan)和環(huan)(huan)(huan)境(jing)(jing)管理(li)水平,分(fen)別選(xuan)擇2個典(dian)型地(di)級市(shi)(shi)(市(shi)(shi)轄區(qu))全(quan)域開展(zhan)(zhan)試(shi)點(dian)(dian)工(gong)作。主要任務是在試(shi)點(dian)(dian)地(di)市(shi)(shi)(區(qu))探(tan)索取(qu)消部分(fen)編制(zhi)環(huan)(huan)(huan)境(jing)(jing)影響報告表項目環(huan)(huan)(huan)評(ping),制(zhi)定試(shi)點(dian)(dian)行業環(huan)(huan)(huan)境(jing)(jing)準入指(zhi)引,探(tan)索主要污染(ran)物總量(liang)指(zhi)標優(you)化配置,探(tan)索加(jia)強(qiang)生態(tai)環(huan)(huan)(huan)境(jing)(jing)分(fen)區(qu)管控和規劃(hua)環(huan)(huan)(huan)評(ping)對建(jian)設項目選(xuan)址(zhi)的指(zhi)導服務,加(jia)強(qiang)排污許可和執法監管。試(shi)點(dian)(dian)工(gong)作方案見附件2。
(二)選(xuan)取(qu)部分(fen)園區(qu)開(kai)展優(you)化(hua)環(huan)評分(fen)類管(guan)理(li)試(shi)(shi)點(dian)(dian)。請上海(hai)市(shi)(shi)、江(jiang)蘇(su)省(sheng)、浙(zhe)江(jiang)省(sheng)、山東省(sheng)、湖南(nan)省(sheng)、重慶市(shi)(shi)等6省(sheng)(市(shi)(shi))生態環(huan)境(jing)(jing)(jing)廳(局)分(fen)別組(zu)(zu)織(zhi)選(xuan)取(qu)2-3個(ge)產業(ye)園區(qu)開(kai)展試(shi)(shi)點(dian)(dian)工作(zuo)。主(zhu)要(yao)任務(wu)是在試(shi)(shi)點(dian)(dian)園區(qu)探索(suo)取(qu)消(xiao)部分(fen)編制環(huan)境(jing)(jing)(jing)影(ying)響報(bao)告(gao)表項目環(huan)評,組(zu)(zu)織(zhi)制定完善(shan)(shan)(shan)試(shi)(shi)點(dian)(dian)園區(qu)環(huan)境(jing)(jing)(jing)準(zhun)入(ru)清單(dan),探索(suo)建立基于(yu)環(huan)境(jing)(jing)(jing)質量改善(shan)(shan)(shan)目標(biao)的園區(qu)污(wu)染物減(jian)排量、入(ru)園企業(ye)許可(ke)排放量的精準(zhun)核算、優(you)化(hua)配置和動態管(guan)理(li)機(ji)制;探索(suo)完善(shan)(shan)(shan)排污(wu)許可(ke)管(guan)理(li),落(luo)實生態環(huan)境(jing)(jing)(jing)分(fen)區(qu)管(guan)控及有關(guan)(guan)規劃(hua)環(huan)評關(guan)(guan)于(yu)建設項目選(xuan)址要(yao)求,研究確定基于(yu)環(huan)境(jing)(jing)(jing)質量改善(shan)(shan)(shan)目標(biao)的許可(ke)排放量;強化(hua)排污(wu)許可(ke)提前服務(wu)管(guan)理(li),保(bao)障對試(shi)(shi)點(dian)(dian)行業(ye)項目環(huan)境(jing)(jing)(jing)準(zhun)入(ru)管(guan)理(li)的承接與(yu)補位;探索(suo)加強排污(wu)許可(ke)“一證式”監管(guan),對無證排污(wu)、不(bu)按證排污(wu)的企業(ye)依法嚴肅查處。試(shi)(shi)點(dian)(dian)工作(zuo)方案見附件(jian)3。
四(si)、開展環評文件(jian)標準化編制、智能化輔助審批試點
選(xuan)(xuan)(xuan)(xuan)取(qu)北京市(shi)(shi)(shi)海淀區(qu)(qu)(qu)、浙(zhe)江省杭州市(shi)(shi)(shi)、福建(jian)(jian)省廈門市(shi)(shi)(shi)、四川省成(cheng)(cheng)都市(shi)(shi)(shi)等(deng)4個試(shi)(shi)點地市(shi)(shi)(shi)(區(qu)(qu)(qu)),篩選(xuan)(xuan)(xuan)(xuan)工(gong)藝簡單、環(huan)(huan)(huan)(huan)境(jing)(jing)影響較輕、污染(ran)防治措(cuo)施成(cheng)(cheng)熟(shu)可靠的行業(ye)(ye)開展試(shi)(shi)點,主要任務是推(tui)進(jin)(jin)環(huan)(huan)(huan)(huan)評(ping)(ping)(ping)(ping)(ping)文(wen)件(jian)(jian)(jian)質量(liang)提升。一是實(shi)現基本信息(xi)填報標準化。通過信息(xi)化手段,實(shi)現企(qi)業(ye)(ye)在(zai)(zai)線點選(xuan)(xuan)(xuan)(xuan)、填報相(xiang)關信息(xi),輔(fu)助(zhu)生(sheng)成(cheng)(cheng)環(huan)(huan)(huan)(huan)評(ping)(ping)(ping)(ping)(ping)文(wen)件(jian)(jian)(jian),精簡環(huan)(huan)(huan)(huan)評(ping)(ping)(ping)(ping)(ping)文(wen)件(jian)(jian)(jian)編制(zhi)內(nei)(nei)容,提升環(huan)(huan)(huan)(huan)評(ping)(ping)(ping)(ping)(ping)文(wen)件(jian)(jian)(jian)編制(zhi)效率。二是推(tui)動選(xuan)(xuan)(xuan)(xuan)址(zhi)論證智(zhi)能(neng)(neng)化。集成(cheng)(cheng)生(sheng)態環(huan)(huan)(huan)(huan)境(jing)(jing)分(fen)區(qu)(qu)(qu)管控、生(sheng)態環(huan)(huan)(huan)(huan)境(jing)(jing)功能(neng)(neng)區(qu)(qu)(qu)劃、要素管理(li)等(deng)空間數(shu)(shu)(shu)據(ju),實(shi)現企(qi)業(ye)(ye)點選(xuan)(xuan)(xuan)(xuan)建(jian)(jian)設(she)項(xiang)(xiang)目地址(zhi),勾選(xuan)(xuan)(xuan)(xuan)行業(ye)(ye)類別,填寫建(jian)(jian)設(she)內(nei)(nei)容、規(gui)模(mo)等(deng)基礎(chu)信息(xi),研判項(xiang)(xiang)目選(xuan)(xuan)(xuan)(xuan)址(zhi)是否可行,生(sheng)成(cheng)(cheng)選(xuan)(xuan)(xuan)(xuan)址(zhi)環(huan)(huan)(huan)(huan)境(jing)(jing)合(he)理(li)性分(fen)析內(nei)(nei)容。三是提高預(yu)(yu)測評(ping)(ping)(ping)(ping)(ping)價(jia)規(gui)范化水平。嵌套(tao)環(huan)(huan)(huan)(huan)評(ping)(ping)(ping)(ping)(ping)預(yu)(yu)測模(mo)型和參數(shu)(shu)(shu)體系,調用符合(he)要求(qiu)的自動監測數(shu)(shu)(shu)據(ju)或周邊(bian)相(xiang)關園區(qu)(qu)(qu)、項(xiang)(xiang)目監測數(shu)(shu)(shu)據(ju),銜接工(gong)程分(fen)析內(nei)(nei)容及(ji)環(huan)(huan)(huan)(huan)境(jing)(jing)質量(liang)現狀、環(huan)(huan)(huan)(huan)境(jing)(jing)敏感目標、環(huan)(huan)(huan)(huan)境(jing)(jing)基礎(chu)設(she)施等(deng)數(shu)(shu)(shu)據(ju),在(zai)(zai)線完(wan)成(cheng)(cheng)環(huan)(huan)(huan)(huan)境(jing)(jing)影響預(yu)(yu)測評(ping)(ping)(ping)(ping)(ping)價(jia)。四是推(tui)進(jin)(jin)智(zhi)能(neng)(neng)化輔(fu)助(zhu)環(huan)(huan)(huan)(huan)評(ping)(ping)(ping)(ping)(ping)審(shen)批(pi)(pi)。梳(shu)理(li)試(shi)(shi)點行業(ye)(ye)歷(li)史項(xiang)(xiang)目審(shen)批(pi)(pi)結果,形成(cheng)(cheng)審(shen)批(pi)(pi)規(gui)則。以環(huan)(huan)(huan)(huan)評(ping)(ping)(ping)(ping)(ping)文(wen)件(jian)(jian)(jian)為分(fen)析對象,通過智(zhi)能(neng)(neng)檢索引擎技(ji)術,抓取(qu)環(huan)(huan)(huan)(huan)評(ping)(ping)(ping)(ping)(ping)文(wen)件(jian)(jian)(jian)中項(xiang)(xiang)目位(wei)置、建(jian)(jian)設(she)內(nei)(nei)容、關鍵工(gong)藝和特征污染(ran)物等(deng)關鍵信息(xi),結合(he)行業(ye)(ye)相(xiang)關管理(li)要求(qiu),進(jin)(jin)行對比分(fen)析,按照規(gui)定內(nei)(nei)容格(ge)式,生(sheng)成(cheng)(cheng)輔(fu)助(zhu)環(huan)(huan)(huan)(huan)評(ping)(ping)(ping)(ping)(ping)批(pi)(pi)復意見(jian)(jian),供最(zui)終批(pi)(pi)復意見(jian)(jian)制(zhi)定參考。試(shi)(shi)點工(gong)作(zuo)方(fang)案見(jian)(jian)附件(jian)(jian)(jian)4。
五、加強組織保(bao)障
(一(yi))加強(qiang)組織(zhi)領導。生(sheng)態環(huan)境(jing)部(bu)將(jiang)建立環(huan)評(ping)改革試(shi)(shi)(shi)點(dian)(dian)(dian)(dian)保障機制,對(dui)試(shi)(shi)(shi)點(dian)(dian)(dian)(dian)工(gong)(gong)作(zuo)開(kai)展全(quan)程跟(gen)蹤指導,保障工(gong)(gong)作(zuo)方案(an)見附件5。各(ge)省級生(sheng)態環(huan)境(jing)部(bu)門(men)(men)要加強(qiang)改革任務(wu)統(tong)(tong)籌(chou)實(shi)施,對(dui)于項目(mu)環(huan)評(ping)審(shen)批權(quan)限(xian)優化(hua)調整工(gong)(gong)作(zuo),要充分(fen)利用全(quan)國(guo)建設項目(mu)環(huan)評(ping)統(tong)(tong)一(yi)申(shen)報和審(shen)批系(xi)統(tong)(tong),做好各(ge)級審(shen)批能力摸底評(ping)估(gu),科學優化(hua)調整審(shen)批權(quan)限(xian)。承擔試(shi)(shi)(shi)點(dian)(dian)(dian)(dian)工(gong)(gong)作(zuo)任務(wu)的省級生(sheng)態環(huan)境(jing)部(bu)門(men)(men)要精(jing)心組織(zhi)試(shi)(shi)(shi)點(dian)(dian)(dian)(dian)地(di)市(shi)制定試(shi)(shi)(shi)點(dian)(dian)(dian)(dian)工(gong)(gong)作(zuo)方案(an),完善工(gong)(gong)作(zuo)機制,明確工(gong)(gong)作(zuo)人員,細化(hua)試(shi)(shi)(shi)點(dian)(dian)(dian)(dian)任務(wu)、工(gong)(gong)作(zuo)進度、責任分(fen)工(gong)(gong)和預期成效(xiao),確保試(shi)(shi)(shi)點(dian)(dian)(dian)(dian)有序(xu)穩步(bu)推(tui)進。
(二(er))加強(qiang)(qiang)改(gai)革保(bao)障。各(ge)省(sheng)級生(sheng)態環(huan)境(jing)(jing)(jing)部(bu)門要(yao)深化(hua)生(sheng)態環(huan)境(jing)(jing)(jing)分區管(guan)(guan)(guan)控、產業(ye)園(yuan)(yuan)區規劃環(huan)評(ping)(ping)、建設項(xiang)目(mu)環(huan)評(ping)(ping)和(he)(he)排(pai)污(wu)許可以及(ji)排(pai)污(wu)權交(jiao)易制度銜接融合(he),強(qiang)(qiang)化(hua)園(yuan)(yuan)區規劃環(huan)評(ping)(ping)和(he)(he)入園(yuan)(yuan)項(xiang)目(mu)環(huan)境(jing)(jing)(jing)準入管(guan)(guan)(guan)理(li)(li)。加強(qiang)(qiang)技術(shu)評(ping)(ping)估能(neng)力建設,加強(qiang)(qiang)環(huan)評(ping)(ping)關鍵技術(shu)科研攻關,提升源(yuan)頭預防(fang)制度體系整體效(xiao)力。各(ge)級生(sheng)態環(huan)境(jing)(jing)(jing)部(bu)門要(yao)將承擔(dan)項(xiang)目(mu)環(huan)評(ping)(ping)審(shen)(shen)(shen)批的(de)相(xiang)關部(bu)門納入政策指導、業(ye)務培(pei)訓、環(huan)評(ping)(ping)文件(jian)復核、信(xin)息(xi)(xi)化(hua)監(jian)管(guan)(guan)(guan)等工作體系,確保(bao)項(xiang)目(mu)環(huan)評(ping)(ping)全部(bu)在全國建設項(xiang)目(mu)環(huan)評(ping)(ping)統(tong)(tong)一申報和(he)(he)審(shen)(shen)(shen)批系統(tong)(tong)進(jin)行(xing)受理(li)(li)審(shen)(shen)(shen)批,相(xiang)關信(xin)息(xi)(xi)共享至投資(zi)項(xiang)目(mu)在線審(shen)(shen)(shen)批監(jian)管(guan)(guan)(guan)平臺,做到(dao)統(tong)(tong)一尺(chi)度、規范把(ba)關。
(三(san)(san))加強環(huan)評(ping)(ping)文件(jian)(jian)質量(liang)監(jian)管(guan)(guan)。各(ge)級生(sheng)(sheng)態(tai)環(huan)境(jing)部(bu)門(men)要(yao)把提升環(huan)評(ping)(ping)文件(jian)(jian)質量(liang)擺(bai)在更加突出位(wei)(wei)置,嚴(yan)(yan)格準入(ru)把關和(he)監(jian)管(guan)(guan)。在審(shen)批過程(cheng)中將環(huan)評(ping)(ping)單(dan)位(wei)(wei)落實(shi)環(huan)境(jing)影響(xiang)評(ping)(ping)價工作(zuo)(zuo)(zuo)(zuo)程(cheng)序、編(bian)(bian)制主持人(ren)全過程(cheng)組織參與環(huan)境(jing)影響(xiang)報告(gao)書(表)編(bian)(bian)制工作(zuo)(zuo)(zuo)(zuo)等情(qing)況納入(ru)監(jian)管(guan)(guan),有關檔案、資料造假或者故意違反工作(zuo)(zuo)(zuo)(zuo)程(cheng)序等基礎資料明顯不實(shi)的(de)(de),應依法嚴(yan)(yan)肅查處。落實(shi)信(xin)用監(jian)管(guan)(guan)機制,對(dui)信(xin)用良(liang)好的(de)(de)環(huan)評(ping)(ping)單(dan)位(wei)(wei),減少復核和(he)抽查的(de)(de)比例(li)、頻次(ci),做(zuo)到“無事不擾”,對(dui)納入(ru)“黑(hei)名單(dan)”的(de)(de)環(huan)評(ping)(ping)單(dan)位(wei)(wei)依法禁止從業,對(dui)信(xin)用較差的(de)(de)環(huan)評(ping)(ping)單(dan)位(wei)(wei),住(zhu)所(suo)所(suo)在地(di)市級生(sheng)(sheng)態(tai)環(huan)境(jing)部(bu)門(men)應每年開展現場檢查,確保具備(bei)基本技(ji)術(shu)能力等條(tiao)件(jian)(jian)。強化(hua)責(ze)任(ren)(ren)(ren)追(zhui)究(jiu),深入(ru)開展第三(san)(san)方環(huan)保服務(wu)機構弄(nong)虛作(zuo)(zuo)(zuo)(zuo)假問題專項整治工作(zuo)(zuo)(zuo)(zuo),對(dui)照《關于嚴(yan)(yan)懲弄(nong)虛作(zuo)(zuo)(zuo)(zuo)假提高(gao)環(huan)評(ping)(ping)質量(liang)的(de)(de)意見》規(gui)定的(de)(de)典(dian)型弄(nong)虛作(zuo)(zuo)(zuo)(zuo)假情(qing)形,及時發(fa)現、嚴(yan)(yan)厲查處,嚴(yan)(yan)格落實(shi)建設(she)單(dan)位(wei)(wei)、環(huan)評(ping)(ping)單(dan)位(wei)(wei)責(ze)任(ren)(ren)(ren),對(dui)相(xiang)關單(dan)位(wei)(wei)和(he)責(ze)任(ren)(ren)(ren)人(ren)依法實(shi)施(shi)(shi)“雙罰(fa)制”,按照《環(huan)境(jing)影響(xiang)評(ping)(ping)價法》第三(san)(san)十二條(tiao)相(xiang)關規(gui)定實(shi)施(shi)(shi)終身(shen)責(ze)任(ren)(ren)(ren)追(zhui)究(jiu),涉(she)嫌犯(fan)罪的(de)(de)依法追(zhui)究(jiu)刑事責(ze)任(ren)(ren)(ren),嚴(yan)(yan)肅追(zhui)究(jiu)技(ji)術(shu)評(ping)(ping)估單(dan)位(wei)(wei)、審(shen)批部(bu)門(men)把關責(ze)任(ren)(ren)(ren),并廣(guang)泛開展典(dian)型案件(jian)(jian)警示教育。
(四)工(gong)作(zuo)時(shi)限(xian)要(yao)求。各省(sheng)(sheng)級(ji)生(sheng)態環(huan)境(jing)部(bu)門(men)應(ying)于(yu)(yu)2024年10月(yue)底前(qian),完成(cheng)項目環(huan)評(ping)(ping)審(shen)批權限(xian)優化(hua)調(diao)整(zheng)方案,依法(fa)報(bao)請省(sheng)(sheng)級(ji)人民政府作(zuo)出調(diao)整(zheng)規定;12月(yue)底前(qian)將經(jing)省(sheng)(sheng)級(ji)人民政府同意的項目環(huan)評(ping)(ping)審(shen)批權限(xian)優化(hua)調(diao)整(zheng)結果報(bao)告(gao)(gao)生(sheng)態環(huan)境(jing)部(bu);涉及需要(yao)修(xiu)改地(di)方性法(fa)規或地(di)方政府規章的,依法(fa)定程序對環(huan)評(ping)(ping)審(shen)批權限(xian)作(zuo)出調(diao)整(zheng)。承擔(dan)試(shi)點任(ren)務的省(sheng)(sheng)級(ji)生(sheng)態環(huan)境(jing)部(bu)門(men)應(ying)于(yu)(yu)本通知(zhi)印發后兩個月(yue)內編制完成(cheng)試(shi)點實施(shi)方案并(bing)報(bao)送生(sheng)態環(huan)境(jing)部(bu),于(yu)(yu)2025年9月(yue)底前(qian)報(bao)送試(shi)點工(gong)作(zuo)總結報(bao)告(gao)(gao),試(shi)點實施(shi)方案和試(shi)點工(gong)作(zuo)總結報(bao)告(gao)(gao)模板見附件6。
